Welcome to Nicepaper. These Terms & Conditions ("Terms") govern your use of the Nicepaper service. By using Nicepaper, you agree to these Terms. Please read them carefully.

1. Overview of Service

Nicepaper is a monthly subscription service that creates personalized printed newspapers featuring updates from your friends and family.

1.1 How It Works

• Everyone (subscribers and contributors) receives 3-4 themed questions each month via text
• Everyone answers via text, voice memo, or photo
• Subscribers receive printed newspapers with everyone's responses
• Contributors receive a digital version of the subscriber's responses
• Everyone stays in the loop about what's happening in each other's lives

2. Eligibility

You must be at least 18 years old to use Nicepaper. By using the service, you represent that you meet this age requirement.

3. Participation

3.1 Subscribers (Paying Users)

As a subscriber, you:

• Pay a monthly subscription fee
• Invite friends and family to contribute to your newspaper
• Answer the same monthly questions as your contributors
• Receive a printed newspaper with everyone's responses
• Receive it free for contributors (they get your responses digitally)

3.2 Contributors (Non-Paying Participants)

As a contributor, you:

• Participate for free (no payment required)
• Are invited by a subscriber
• Answer 3-4 questions per month via conversational text interview
• Receive a digital version of the subscriber's responses
• Can opt out anytime by texting STOP

4. Subscription Terms (For Subscribers)

4.1 Pricing

Monthly Subscription

$8-15/month (pricing varies based on participation)

4.2 Billing

• Subscriptions are billed monthly on the date you subscribed
• Payment processed via Stripe
• Automatic renewal unless you cancel

4.3 Free Trial

We may offer a free trial period for new subscribers. Terms will be specified at signup. You can cancel anytime during the trial without being charged.

4.4 Refund Policy

• Response Rate Guarantee: If fewer than 60% of your contributors respond, we won't charge you for that month
• Shipping Issues: We'll reprint and reship at no charge if your newspaper is lost or damaged
• No Refunds: For cancellations after newspaper has been printed and shipped

4.5 Cancellation

• Cancel anytime from your account settings
• Cancellation takes effect at the end of your current billing period
• You'll receive newspapers through the end of your paid period
• No refunds for partial months

5. Contributor Terms (For Non-Paying Participants)

5.1 Participation

• You receive 3-4 questions per month via conversational SMS interview
• Responding is voluntary but encouraged
• Your responses appear in printed newspapers of subscribers who invited you
• You may be added to multiple subscribers' networks
• You answer once; responses populate all relevant newspapers

5.2 What You Receive

• Monthly questions via SMS (free to participate)
• Digital version of the subscriber's responses
• Ability to upgrade to subscriber anytime

5.3 Opting Out

• Text STOP anytime to opt out
• You'll be removed from all newspapers within 24 hours
• Past responses in already-printed newspapers cannot be removed
• You can re-opt-in by texting START

6. Content and Intellectual Property

6.1 Your Content

When you submit responses (text, voice, photos):

• You retain ownership of your content
• You grant Nicepaper a license to use your content in newspapers
• This license includes: reproduction, printing, distribution to subscribers
• The license is non-exclusive, perpetual, and irrevocable for already-printed newspapers
• You can request removal from future newspapers by opting out

6.2 Your Responsibilities

You agree NOT to submit content that:

• Violates any laws or regulations
• Infringes on others' intellectual property rights
• Contains hate speech, harassment, or threats
• Contains explicit sexual content
• Contains personal information of others without consent
• Is spam or commercial advertising

6.3 Nicepaper's Content

• Questions are curated and owned by Nicepaper
• Newspaper layout and design are owned by Nicepaper
• You may not republish or redistribute newspapers without permission

7. SMS/Text Messaging Terms

7.1 Consent

By providing your phone number and opting in, you consent to receive:

• Monthly questions (3-4 per month)
• Follow-up questions from our conversational AI system
• Reminder messages if you haven't responded
• Digital response delivery notifications

7.2 Message Frequency

Approximately 5-15 messages per month, depending on your response activity.

7.3 Costs

Message and data rates may apply from your carrier. Nicepaper does not charge for SMS, but your carrier may.

7.4 Opt-Out

Text STOP at any time. Text HELP for assistance.

8. Privacy and Data Use

Your use of Nicepaper is also governed by our Privacy Policy. Key points:

• We collect phone numbers, names, and responses
• Responses are used to create printed newspapers
• Voice memos are transcribed and may be reviewed for quality
• We share information with service providers (Twilio, printers, shipping)
• We do not sell your personal information

9. Quality and Delivery

9.1 Newspaper Production

• Newspapers are printed in black and white on newsprint
• Tabloid format (11×17), folded
• 12-16 pages typical length
• Quality depends on contributor response rates and response quality
• Includes crosswords and puzzles based on responses

9.2 Delivery

• Newspapers shipped via USPS
• We only print when your newspaper is ready (60%+ response rate)
• Delivery typically 2-3 weeks after month end
• Shipping included in subscription price (US only)
• International shipping not currently available

9.3 Response Rate Guarantee

If fewer than 60% of your contributors respond in any month, we won't charge you for that month. This is our quality guarantee.

10. Prohibited Uses

You may not:

• Use Nicepaper for commercial purposes without our permission
• Spam contributors with excessive invitations
• Scrape, copy, or reproduce our question database
• Reverse engineer or attempt to access our systems
• Use Nicepaper to harass or spam others
• Impersonate others or provide false information
• Violate any applicable laws or regulations

11. Termination

11.1 By You

• Subscribers: Cancel anytime from account settings
• Contributors: Text STOP to opt out

11.2 By Nicepaper

We may suspend or terminate your account if you:

• Violate these Terms
• Submit inappropriate content repeatedly
• Engage in fraudulent activity
• Harass other users

Termination does not entitle you to a refund for the current billing period.

12. Disclaimers

12.1 Service Provided "As Is"

Nicepaper is provided "as is" and "as available" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• Specific contributor response rates (except our 60% guarantee)
• Specific newspaper quality or length
• Compatibility with all devices or carriers

12.2 Third-Party Services

We use third-party services (Twilio, printers, USPS). We're not responsible for their failures or errors.

13. Limitation of Liability

To the maximum extent permitted by law:

• Nicepaper's total liability is limited to the amount you paid in the past 12 months
• We're not liable for indirect, incidental, or consequential damages
• We're not liable for delivery delays caused by USPS
• We're not liable for content submitted by other users

14. Indemnification

You agree to indemnify and hold Nicepaper harmless from any claims arising from:

• Your use of the service
• Content you submit
• Your violation of these Terms
• Your violation of others' rights

15. Dispute Resolution

15.1 Informal Resolution

If you have a dispute, please contact us first. We'll work to resolve it informally.

15.2 Arbitration

Any disputes will be resolved through binding arbitration rather than in court, except you may bring claims in small claims court.

15.3 Class Action Waiver

You agree not to participate in class actions, class arbitrations, or representative actions against Nicepaper.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

17. Changes to Terms

We may update these Terms from time to time. Changes will be posted with an updated "Last Updated" date. Continued use after changes constitutes acceptance.

For material changes, we'll notify you via email or SMS.

18. Miscellaneous

18.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Nicepaper.

18.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

18.3 No Waiver

Our failure to enforce any right doesn't constitute a waiver of that right.

18.4 Assignment

You may not assign these Terms. We may assign them without restriction.
